Introduction

La Place Food B.V. (“La Place”) considers the safety and confidentiality of your personal data to be one of its top priorities. This privacy policy explains how we safeguard your privacy and the protection of your personal data. This privacy policy pertains to data that we process from customers of our La Place shops, website or mobile applications, including La Place Extra.

We treat all the data that you provide in strict confidence and always in accordance with the applicable laws and regulations. We process your data solely for the purpose for which we have obtained them. This purpose can be to inform you about offers from La Place, but also to assign the correct La Place Extra status.

Amendments

We may amend this privacy policy from time to time, for example if we start providing new services. The most recent version of this privacy policy is posted on www.laplace.com (“Website”) under the heading Privacy.

This privacy policy was most recently amended in October 2021. 

Recipients

Certain data that you provide to us may be shared with third parties we engage such as printing companies and processors of email and post. These parties process your data solely on the instructions of and on behalf of La Place. In the event of such processing, La Place ensures that there are contractual provisions to prevent third parties from using your personal data for purposes other than those described in this privacy policy, and that such third parties have taken the security measures that are necessary for protecting your personal data from non-authorised processing as well as from unintentional loss, destruction or damage.

Younger than 16?

If you are not yet 16, you may only provide your personal data to us if you have obtained consent for this from one of your parents or a statutory representative who has read this privacy policy.

Security and retention period

The personal data that we collect via the Website are secured using current customary techniques. La Place retains your personal data for as long as you have an account or for as long as provided for by law. La Place always complies with the applicable laws and regulations when securing and storing your personal data.

La Place Extra

By registering for La Place Extra, you consent to La Place storing your personal data - including your name, postcode, email address, date of birth and telephone number - in a secured database and keeping you informed about all La Place Extra activities and offers. If you participate in La Place Extra, La Place builds up a profile of you and keeps track of the frequency of your purchases in order to place you in the correct La Place Extra category (1, 2 or 3 stars). We use these data mainly to enable us to perform the agreement to which you are party, specifically to provide the La Place Extra services to you.

We can also use La Place Extra to keep track of how many purchases you have made. We build up a profile of you based on your purchasing frequency and behaviour. If you use La Place Extra via the Website, we also monitor your visiting behaviour to build up your profile; however, we also do this in order to adjust and improve the service provision of La Place. We do this because you have consented to this.

Your profile is also used to send you personal offers and to give you discounts on subsequent purchases. The higher your La Place Extra status, the more discounts and benefits we can offer you. We process your date of birth, for La Place Extra, so that we can possibly send you a free product or surprise on your birthday. We carry out this processing because you have consented to it. If you no longer wish to participate in La Place Extra, you can indicate this on La Place Guest Service (see below).

La Place uses automated individual decision-making when building your profile and making personal offers. An algorithm decides which offers are most suited to you based on your choices and your use of La Place Extra. This means that you will see offers that are specifically tailored to you.  We display offers based on automated individual decision-making on the basis of the consent you have granted.

Besides sending you personal offers, your profile is also used to show you personalized recommendations. These offers and recommendations can be brought to your attention through the Website, the La Place Extra app of through websites of third parties.
 
For this, La Place makes use of, among other things:

  • The products that you purchase
  • Your personal preferences
  • The functionalities that you use
  • Your surfing behavior on the Website
  • Data collected through cookies

La Place Newsletter

We would like to keep you informed of our activities and offers. You can therefore register for our La Place Newsletter. The use of your email address for direct marketing purposes may be regarded as being carried out in La Place's legitimate interest.

If you no longer wish to receive the newsletter, you can unsubscribe in your own La Place Extra environment. Every email that La Place sends to you also gives you to the possibility of unsubscribing.

La Place Guest Service

If you send a question or a comment via the Website's La Place Guest Service, we process the personal data you provide, including your name, address, postcode, place of residence, telephone number, email address and your question or comment. We process these data solely in order to deal with your question or comment and to contact you with a response to your question or comment. This processing of your data is necessary for the purposes of La Place's legitimate interests, which is specifically to provide customer service. With your consent, we can also use the personal data you provide to send you a request to participate in a survey.

La Place Meeting Rooms

If you make a reservation via the Website for a La Place meeting room, we ask you to provide the following personal data: company name, first name, last name, address, zip code, city, phone number, e-mail and billing information. We use these data to enable us to perform the agreement to which you are party, to provide the La Place Meeting Room services to you.

Website

Our web server automatically recognises your IP address every time you visit the Website. When you visit the Website, we also retain:

  • your email address if you post questions on the Website;
  • your email address if you communicate it to us;
  • the domain names of other sites that you have used to visit the Website;
  • all information with regard to the pages you have opened on the Website.

We use this information solely to:

  • improve the Website content and to bring it more closely in line with the wishes of our visitors;
  • to determine the number of visits to the Website.

Cookies

We use cookies on the Website. Cookies are small text files that are stored on your hard disk or in the memory of your mobile telephone, computer or tablet (“Device”) when you visit the Website.  The cookies placed via the Website cannot damage your Device or any of the files you have stored on it. Both La Place and other parties can use cookies.

There are various types of cookies. An annex is attached to this privacy policy which states (i) what cookies La Place uses, (ii) who places cookies (La Place or another party), (iii) the period of validity of cookies, (iv) the purpose of the cookie concerned, and (v) the consequences if a cookie is not accepted.

What does La Place use cookies for?

La Place uses technical and functional cookies to provide a user-friendly Website or to obtain information about the quality or effectiveness of the Website. Functional cookies, for example, ensure that you do not have to log on to every page separately after logging on to the Website, and they remember settings such as your language preferences.

La Place uses Google Analytics to collect web statistics about the use of and visits to the Website. Google Analytics places a permanent cookie on your Device which is used to register your use of the Website. Google then analyses these data and supplies the results to La Place; this provides La Place with information on traffic to and from the Website and how the Website is used. Based on these data, La Place can then make any necessary adjustments to the Website or its service provision. La Place transfers the data that it obtains in this regard to Google, which it stores on servers in the United States. We have concluded a processor's agreement with Google that sets out arrangements on how it deals with the data that have been collected. In it, La Place does not give Google authorisation to use the information obtained for other Google services. Facebook Website Custom Audiences

La Place uses the Facebook tool called Website Custom Audiences to display advertisements relevant to you on Facebook. Using a pixel integrated into La Place's Website, general information about your browser session, including any Facebook cookie and the web page you visit, are sent to Facebook. Based on these data, Facebook users can be placed in a certain Custom Audience and can be sent tailored advertisements.

The data collected in this manner are not linked to the data in your profile that is built up when you use the La Place Extra app and the Website.

Deleting cookies

You can configure your browser to delete installed cookies and no longer receive any cookies the next time you visit the Website. The following links explain how you can delete different types of cookies on various browsers:

Warning: if you disable or delete cookies, you might be refused access to the Website (or parts of it), or the Website might not function optimally. The best way of finding out more about how these functions work is to read your browser instructions or the Help section in your browser.

How are your personal data protected?

La Place takes appropriate technical and organisational measures to secure your data against loss or any form of unlawful processing.

What are your rights?

As a data subject, you have a number of rights under privacy legislation. This section of the privacy policy describes these rights and how you can invoke them.

Response

We endeavour to respond to your requests as soon as possible but in any case within one month. We could need more time, however. In that case, we will let you know that within this month. You will not have to wait more than another two months.

We might reject your request, for example because it is unfounded or excessive or because we cannot or are not obliged (by law) to satisfy it. We will also inform you if we reject your request.  We might also ask you to provide proof of identity before we process your request.

Please note that if we reject any request from you, you have the right to submit a complaint to the Dutch Data Protection Authority.   

Right of access

You have the right to submit a request to find out whether we process personal data about you. If that is the case, we will, in accordance with the law, send you a copy of the personal data we have collected on you.

Right to rectification

You have the right to submit a request for the rectification of inaccurate personal data concerning you. If possible, you also have the right to provide additional personal data in order to complete the personal data we have collected.

Right to be forgotten

You have the right to request that certain personal data concerning you be deleted (the right to be forgotten). If your request is granted, we will delete the personal data in question.

Right to restriction of processing

You have the right to submit a request for a restriction of processing your personal data. This means that, if your request for a restriction is granted,  we will not process your personal data any further during the period of the restriction unless this is allowed by law.

Right to object

In certain circumstances, you have the right to object to the processing of your personal data, for example if we process your personal data on the basis of a legitimate interest. If you submit an objection, we will weigh up your privacy interests against our business interests. If your interest prevails, we will not process your personal data any further.

If your personal data are used for direct marketing, you can always object to their processing. In that case we will no longer process your personal data for that purpose.

Right to data portability

You have the right to submit a request for data portability. We will make the data to which this right pertains available to you in a structured, commonly used and machine readable format so that you can transfer them to a third party.

How long are your personal data retained?

Your personal data will be carefully retained for no longer than is necessary for the purpose for which they are processed unless La Place is legally obliged to retain them for longer.
